United States Supreme Court has finally ruled on the matter brought to it by Donald Trump, who argued that presidential immunity protects him from prosecution.

Jack Smith had initiated investigation that found grounds for the indictment of the President over his actions to overturn the 2020 election outcome.

Trump had approached Appeal Court to interpret the law guiding him from prosecution while in office, but the court ruled against him.

In a 6-3 ruling in favour of Donald Trump, the United States apex court finally ruled in his favor, throwing the January 6 case in jeopardy.

“The President therefore may not be prosecuted for exercising his core constitutional powers, and he is entitled, at a minimum, to a presumptive immunity from prosecution for all his official acts”

“That immunity applies equally to all occupants of the Oval Office, regardless of politics, policy, or party” the Supreme Court read.

The decision was split among Liberal Judges and Conservatives.

Chief Justice John Roberts’ main opinion did not firmly distance the lower court from going on with prosecution, but argued that the lower court must first differentiate between official and unofficial acts of the President.

“We accordingly remand to the District Court to determine in the first instance — with the benefit of briefing we lack — whether Trump’s conduct in this area qualifies as official or unofficial,” the ruling says.

The case Jack Smith brought against Donald Trump is mainly on the actions he took while in office, and the ruling appears to give Trump an escape from prosecution.

The left and liberals have blasted the ruling, arguing that it gives a President the power to act what pleases him while in office.

Donald Trump reacted to the ruling by saying it’s victory for Americans and the constitution. He further said on Fox News interview immediately after the ruling that he can now campaign freely.

It was expected before the ruling that the former President will be back to the court to continue the case regarding January 6 after he was found guilty on the hush money payment to adult porn star.

Justice Sonia Sotomayor dissented heavily and labeled the Supreme Court ruling “official power for evil ends” saying it gives the President power to violate the law.

She argued that had the court held Donald Trump to account, Presidents’ won’t have liberty to act with impunity, because he would be liable for his actions.

She further said the ruling automatically makes the President “king above the law”

Her arguments are weak, because the court said there is room for official and unofficial act. The difference can well be defined by lower courts.

Official and official acts have to come from motive, explained analysts.

Trump said President Biden has long been using the DOJ to interfere in the election by coming after his main opponent that’s leading him in the polls so far.

The ruling is a massive relief for the former President who will now count on the ruling to overcome the case.

The lower court will almost begin afresh to determine what Supreme Court tagged official and unofficial act.
