Donald Trump’s defence concluded arguments on the lawfare against New York prosecutors, waiting for the Judge, who has been accused of playing to the gallery of Biden’s administration’s two tier justice system, by admitting the case he had easily struck out based on lacking merit to make a ruling.
Judge Juan Merchan has held up the case and often got bashed by Trump and legal experts who believe he is biased. The height of the bias reach a feverish level when he threatened to strike out Trump’s witness testimony on the ground the witness stared down on him.
Trump is answering 34 counts of falsifying business records. He was accused by the prosecutors of paying 130, 000 dollars to Stormy Daniels, an adult film actress to keep quiet after she threatened to disclose her sexual accounter with Donald Trump.
The prosecution are trying to prove to the Judge that Donald Trump made the payment to influence voters in the build up to 2016 presidential election.
The expenses was officially entered as a legal expenses by Trump’s organisation, but the prosecution said it was false, that the payment was a deliberate crime hidden under business record.
The defence argued that the payment was made by Trump’s bitter ex attorney to save Trump’s wife from emotional trauma. The defence further argued that despite making the payment, that the sex claim made by Stormy Daniels was a fake story, and there was nothing wrong with stopping a fake story from coming out to protect one’s family. A move Michael Cohen made on his own accord within his jurisdiction as Trump’s attorney then.
The Judge in the case has often shown veiled disdain for Trump. Placing a gag order on Trump while leaving others to speak freely about Donald Trump and the case. He had threatened Trump with jail term for neglecting his gag order, and fined him on multiple occasions.
The treatment of Trump by the Judge has been worrying, leading to fears that he could pull the trigger against Trump. A move that would dent the image of the Republican’s all but cleared candidate.
Stormy Daniels testimony was allowed to spiral out of context of issue brought by the prosecution, prompting the defence team to ask for mistral, but Judge Merchan ruled against the submission of the defence, allowing Stormy Daniels to target Trump in a trivial manner that only aims to tarnish the image of the poll leading Republican preemptive candidate.
The rulings made so far by Judge Merchan spread fears of possible jail term for Trump. The Judge is touted to be sympathetic to Democrats and is doing the hit job for Joe Biden who is believed by Republicans to using American Justice System against his major political opponent.
No single ruling was made by the judge in favor of Donald Trump throughout the trial. The prosecution and defence rested their cases after weeks of hectic schedules.
The defence had asked for dismissal of the case based on the prosecution could not provide evidence to prove that there was a business falsification record.
It went further to plead the Judge to dismiss the case on a second ground that the star witness of the prosecutor lied.
The star witness during cross-examination was found to have lied that he called and spoke with Trump, whereas he only called Trump’s security to discuss a prank-call threatening him.
The witness admitted during cross-examination to stealing from Trump’s organisation. As a proven perjurer and chronic liar who had been jailed for lying, Michael Cohen’s credibility was questioned. But Judge Merchan sees nothing wrong with him according to critics of the Judge.
Ruling is expected soon, but even though the defence team is confident of victory, surprise could occur hence according to Donald Trump, the prosecution needed a corrupt Judge to even fly the case, hence making the prospect of jail term a reality.
