Analysis | Charges Against Former Governor Ganduje Stir Controversies

Kano, Nigeria – July 18, 2024

Kano State government is determined to bring to book the past governor who it accuses of various fraud related charges.

The state has escalated its legal battle against former governor Abdullahi Ganduje, filing new fraud charges that further complicate his mounting legal troubles.

This development follows previous allegations of financial misconduct during his tenure, raising the stakes in a case that has captivated the nation’s attention.

Charges had been filed against the past governor, who is the chairman of APC. He is fighting the charges and has asked for dismissal of the charges.

New charges were filed against him, which underscores the commitment of the state government to corner him for his alleged fraudulent crimes against the state.

The fresh charges stem from allegations of embezzlement and misappropriation of public funds. Ganduje, who served as governor of Kano State from 2015 to 2023, has consistently denied any wrongdoing.

His legal team argues that the charges are politically motivated, aimed at tarnishing his reputation and diminishing his influence within the All Progressives Congress (APC).

Corruption has been institutionalised by political leaders in the country. Former Prime Minister of UK once called Nigeria “a very, very fantastically corrupt country.” his stressed description stemmed from the way corruption is coordinated in the country.

Each government has a pattern by which corruption is practised and implemented to hide it from the public. Successive government takes over and devices its own pattern.

In Kano State, Ganduje couldn’t install the government that had shielded him from investigation, and with opposition winning, accountability would be demanded.

The former governor is fighting against his probe with everything he could muster. With his high-profile connect and money, there is a pessimistic belief that the case would be frustrated and yield nothing.

Kano State Attorney General, Ibrahim Mukhtar, stated that the new charges are based on recently uncovered evidence. “Our investigation has revealed substantial grounds to believe that former Governor Ganduje engaged in fraudulent activities, resulting in significant financial losses for the state,” Mukhtar said. He emphasized the government’s commitment to holding public officials accountable, irrespective of their status or political affiliation.

The Kano State Attorney General’s comments are not enough to prosecute the former governor successfully. He must prove his case in a competent court of jurisdiction.

Nigerian politicians have also mastered the act of bribery, as much as they mastered the act of corruption. Overwhelming evidence will be needed to prosecute the former governor successfully.

The case has sparked a wave of reactions across the political spectrum. Supporters of Ganduje claim that the charges are part of a broader strategy to discredit him ahead of the 2025 elections, where he is rumoured to be eyeing a significant role.

The governor was once captured in footage receiving kickbacks in dollars, but nothing came out of the case. If the governor could wriggle out of a matter, he was caught red handed, there is no guarantee he would be caught in a matter a burden of proof is on the Attorney General of the state.

Conversely, anti-corruption advocates argue that the charges are a long-overdue step toward addressing the culture of impunity that has plagued Nigerian politics.

To prosecute Nigerian leaders will continue to prove a hard nut to crack. Corruption is practised by all leaders across the country. They can not prosecute one with evidence of links to others, in what could be best described as corruption racketeering club.

Public opinion in Kano is sharply divided. Many residents express disillusionment with the frequent allegations of corruption among their leaders. “We need to see real accountability and not just political theatrics,” said Aisha Abubakar, a local businesswoman. “If Ganduje is guilty, he should face the consequences. But if this is just a smear campaign, it undermines the integrity of our legal system.”

Reacting to the public discontent, Dailytab24 contributor Chido Uka said.

“This matter is not easy or straightforward as many think. You are trying to prosecute a former governor who is the chairman of a ruling party in a country that lacks the rule of law and the requisite structure and history for or of prosecuting past leaders.

“Remember that we are talking about prosecution simply because the new administration is having political problems with him. Had the former governor’s party won, we won’t be here talking about prosecution.

“The state government is trying, but these governors know how to cover their tracks while in office. They are specialists in covering their corruption deals while in office. So, the state government is taking its time to gather everything it needs, and they also have to overcome the people mounting pressure on it to drop the charges”

The former governor’s legal woes began in 2018 when a video surfaced allegedly, showing him receiving bribes from contractors. Although Ganduje dismissed the footage as doctored, the incident sparked widespread outrage and led to multiple investigations. The current charges are believed to be linked to these earlier allegations, with investigators uncovering further evidence of financial misconduct.

Political analysts suggest that the outcome of Ganduje’s trial could have significant implications for Nigeria’s broader anti-corruption efforts. “This case is a litmus test for the judiciary’s independence and the government’s resolve to tackle corruption,” said Dr. Emeka Okoro, a political science professor at the University of Abuja. “A fair and transparent trial will send a strong message that no one is above the law.”

As the legal proceedings unfold, all eyes will be on Kano State’s courts to see how they handle one of the most high-profile corruption cases in recent Nigerian history. The public, weary of endemic corruption, hopes for a resolution that upholds justice and restores faith in the nation’s institutions.

“The people want to see justice in play. They are saying the governor should answer for his crimes. They are also saying that his immunity is over and that nothing should stop the government from successfully prosecuting the case, ” Dailytab24 contributor said.

Most cases of this nature in the country had failed to meet the expectations of the public. It always comes to settlement by the parties involved.
